Scientists to cook world's first in-vitro beef burger

LONDON (Reuters) - A corner of west London will see culinary and scientific history made on Monday when scientists cook and serve up the world's first lab-grown beef burger.

The in-vitro burger, cultured from cattle stem cells, the first example of what its creator says could provide an answer to global food shortages and help combat climate change, will be fried in a pan and tasted by two volunteers.

The burger is the result of years of research by Dutch scientist Mark Post, a vascular biologist at the University of Maastricht, who is working to show how meat grown in petri dishes might one day be a true alternative to meat from livestock.

The meat in the burger has been made by knitting together around 20,000 strands of protein that has been cultured from cattle stem cells in Post's lab.

The tissue is grown by placing the cells in a ring, like a donut, around a hub of nutrient gel, Post explained.

To prepare the burger, scientists combined the cultured beef with other ingredients normally used in burgers, such as salt, breadcrumbs and egg powder. Red beet juice and saffron have been added to bring out its natural colors.

"Our burger is made from muscle cells taken from a cow. We haven't altered them in any way," Post said in a statement on Friday. "For it to succeed it has to look, feel and hopefully taste like the real thing."

VIABLE ALTERNATIVE?

Success, in Post's view, would mean not just a tasty burger, but also the prospect of finding a sustainable, ethical and environmentally friendly alternative to meat production.

According to a 2006 report by the U.N. Food and Agriculture Organization (FAO), industrialized agriculture contributes on a "massive scale" to climate change, air pollution, land degradation, energy use, deforestation and biodiversity decline.

The report, entitled Livestock's Long Shadow, said the meat industry contributes about 18 percent of global greenhouse-gas emissions and this proportion is expected to grow as consumers in fast-developing countries such as China and India eat more meat.

According to the World Health Organization (WHO), annual meat production is projected to rise to 376 million metric tons by 2030 from 218 million metric tons in 1997-1999, and demand from a growing world population is expected to rise beyond that.

Post cites FAO figures suggesting demand for meat is expected to increase by more than two-thirds by 2050.

Animal welfare campaigners applauded the arrival of cultured meat and predicted a great future for it.

"In vitro technology will spell the end of lorries full of cows and chickens, abattoirs and factory farming," the People for the Ethical Treatment of Animals (PETA) campaign group said in a statement. "It will reduce carbon emissions, conserve water and make the food supply safer."

A study published in 2011 comparing the relative environmental impacts of various types of meat, including lamb, pork, beef and cultured meat, said the lab-grown product has by far the least impact on the environment.

Hanna Tuomisto, who conducted the study at Oxford University's Wildlife Conservation Research Unit, found that growing meats in-vitro would use 35 percent to 60 percent less energy, emit 80 percent to 95 percent less greenhouse gas and use around 98 percent less land than conventionally produced animal meat.

While Monday's fry-up will be a world first and only an initial proof-of concept, the Dutch scientist reckons commercial production of cultured beef could begin within the next 20 years.

"What we are going to attempt is important because I hope it will show cultured beef has the answers to major problems that the world faces," he added.

Brent tops $110 first time since April on robust economic data

SINGAPORE (Reuters) - Brent crude futures climbed above $110 a barrel for the first time since early April on Friday, as upbeat economic data raised the prospects for better global oil demand amid supply disruptions in Africa and Iraq.

U.S. manufacturing grew in July at its fastest pace in two years, while a China industrial index beat expectations this week. European factories also snapped two years of output declines, suggesting a euro zone recession may be near its end.

A commitment to easy monetary policy by European central banks and the Federal Reserve also boosted oil prices.

Brent crude oil futures had gained 42 cents to $109.96 a barrel by 0411 GMT, after earlier hitting $110.09, its highest since April 3. Brent is track to rise 2.6 percent on the week after two weeks of losses.

U.S. crude oil futures rose 68 cents to $108.57, heading for a 3.7 percent increase for the week.

"A lot of people are expecting the quantitative easing to continue for longer than expected, so money is still going into the oil markets," said Ken Hasegawa, a commodity sales manager at Newedge Japan.

But with global inventories adequate, he added, oil prices are unlikely to remain strong.

The European Central Bank and the Bank of England on Thursday left their interest rates at record lows, a day after the Federal Reserve said the U.S. economy still needed its support and made no mention of changes to its stimulus measures.

Any pullback on the Fed's easy money policies could boost the dollar and drag on assets denominated in the currency.

Investors are waiting for a U.S. employment report due later in the day that is expected to show the jobless rate near its lowest level in more than four years, which could strengthen demand from the world's top oil consumer.

Data on Thursday showed U.S. factory activity hitting a two-year high in July and first-time applications for jobless benefits hit a 5-1/2-year low last week.

Brent's premium over West Texas Intermediate narrowed to $1.40 a barrel as the positive data and the Fed comments pushed up the U.S. crude oil prices.

"A lot of money has now seemed to have come to the U.S. crude market and I suspect some short covering is happening," said Hasegawa.

SUPPLY DISRUPTIONS

Concern over supply disruptions in Libya, Iraq and Nigeria also underpinned prices. The disruptions helped trim OPEC output to a four-month low in July, according to a Reuters survey published on Wednesday.

OPEC output averaged 30.25 million barrels per day (bpd), down from 30.38 million bpd in June, the survey found.

Iraq's production has come under pressure as Sunni insurgents target its northern pipeline, while technical problems are curbing output in the south.

Europe's biggest oil company, Royal Dutch Shell, said on Thursday that a surge in oil thefts in Nigeria contributed to a lower second-quarter profit.

MINISTER of Defence Geoffrey Mwamba has urged Zambians to venture into agriculture as it is a sustainable way of making a living.
And Vice-President?s wife Charlotte Scott, has described this year?s 87th edition of the Agriculture and Commercial Show as an eye-opener for farmers to diversify crops and adapt to climate change.
Mr Mwamba, who pledged Government?s support towards the sector, said agriculture is the mainstay of the Zambian economy.
?Why should we allow foreigners to take over the agriculture sector when we are able to work more than them? In fact, I have been informed by the Minister of Agriculture and Livestock that there are various support programmes for farmers,? he said.
Mr Mwamba was speaking in Lusaka after touring stands at the Agriculture and Commercial Show yesterday.
The 87th edition of the Agriculture and Commercial Show is running under the theme ?Business in a changing environment?.
The minister said it is time Zambia became a nation of producers to feed the entire nation and export excess produce.
Mr Mwamba, who described the exhibitions at the show as impressive, said he has been encouraged to venture into agriculture in Kasama.
Mr Mwamba expressed optimism that this year?s show will be a success and toured nine local stands.
The minister arrived at the showgrounds around 09:40 and was met by Minister of Agriculture and Livestock Bob Sichinga and other senior Government officials.
Mr Sichinga said his ministry targets to produce 150,000 metric tonnes of fertiliser for the 2013/2014 farming season.
He said 70,000 tonnes of fertiliser will go towards the Fertiliser Input Support Programme (FISP) and the rest will go to the open market.
And Dr Scott said apart from farmers adapting to climate change and conservation farming, this year?s theme will help business people to diversify in their marketing strategy.
She said she was impressed that both farmers and business people have come up with new ways of doing business.
She pinpointed companies like Zesco, who are working tirelessly to meet the demand for electricity countryside, mitigate load shedding and build more hydro-power stations.
Dr Scott was also impressed with young farmers from rural areas who she said have more information and knowledge on climate change.
She commended NIPA for coming up with degree programmes and building a modern library.
She arrived at the Show Grounds around 09:10 hours and toured eight stands in the company of show society past president Elizabeth Nkumbula.

Shrapnel from imploding plant injures 5 spectators

BAKERSFIELD, Calif. (AP) ? One man had his leg severed Saturday and four others were also injured as shrapnel from the demolition of a power plant flew into a crowd of more than 1,000 spectators that had gathered in California's Central Valley to watch it come down, officials said.

The crowd gathered at 6 a.m., some sleeping in their cars overnight, in the nearby parking lot of a Lowe's Home Improvement store in Bakersfield to watch the planned implosion of the steam power plant owned by the public utility Pacific Gas and Electric that had been decommissioned for decades.

After buildings came down in a fiery crash, a police officer heard a man screaming for help and saw that his leg had been blown off.

"It was a piece of shrapnel that came flying out of the explosion and came across and went through a couple of chain link fences," said police Lt. Scott Tunnicliffe.

The 44-year-old victim also had major injuries to the other leg, and may lose it also, Tunnicliffe said. Officials declined to release his name.

Four other spectators were treated for minor injuries, said Kern County Fire engineer Leland Davis. All of the injured spectators were standing beyond a perimeter set up to ensure public safety, Davis said.

Fred Garten, 49, was standing behind the perimeter when a piece of metal roughly the size of a household door came flying at him and grazed his right leg, leaving his socks and shorts splattered with blood.

"It's a good gouge, but it's just scratches," Garten told the Bakersfield Californian, which first reported on the incident. "I just feel bad for the other guy. They took him away on a gurney, and I'm walking."

Kelly Patt, 21, who arrived five hours early to get a good view of the blast, said his girlfriend got sprayed with shrapnel but wasn't badly hurt. Patt said he was far more disturbed at seeing the man with the severed leg.

"I saw that dude's leg and I had to walk away," he told the Californian. "There was a lot of blood, a lot of blood."

Several cars were also damaged by the shrapnel.

Residents of the city about 100 miles northwest of Los Angeles were eager to see the old plant torn down to make way for new development. The plant was decommissioned in 1986 and has been idle ever since.

Pacific Gas and Electric reached an agreement with the city to clean up the property and prepare it for sale. The company hired subcontractors to handle the demolition of the plant's boiler structures and worked with local authorities to set up a safe perimeter 1,000 feet from the site, said Denny Boyles, a company spokesman.

"We are deeply saddened that this happened," Boyles said. "We're looking for answers like everyone else."

Boyles said the boiler structure consisted of two towers measuring 140 feet high that supported four 200,000 gallon tanks.

Cleveland Wrecking Co. of Covina, Calif., the main contractor on the demolition, issued a statement expressing sympathy and vowing a thorough investigation but declined further comment.

"This was a terrible accident, and our hearts go out to the individuals who were injured," the statement said. "We will be conducting a full investigation and will cooperate with the authorities."

Several subcontractors also worked on the project.

A previous accident at the same demolition site in 2012 killed a 51-year-old Cleveland Wrecking worker who was suspended in a basket and cutting beams with a torch when one of the beams hit him and he fell 50 feet to his death.

In June of this year in Philadelphia, the wall of a building under demolition collapsed onto a thrift store and killed six people. That contractor was not among those hired for the Bakersfield plant.

Iran supreme leader endorses Rouhani for president

TEHRAN, Iran (AP) ? Iran's supreme leader has formally endorsed Hasan Rouhani as president, opening the way for the moderate cleric to take over from outgoing President Mahmoud Ahmadinejad.

In a ceremony broadcast live on state television Saturday, Ayatollah Ali Khamenei gave his official approval for Rouhani. Khamenei, the ultimate authority in Iran, has final say in all key matters, including Rouhani's upcoming selections for key Cabinet posts such as the foreign and intelligence ministers.

Rouhani will take the oath of office in parliament Sunday.

Rouhani won a landslide victory in June 14 presidential elections. He has pledged to follow a "path of moderation" and promised greater openness over the country's nuclear program, which has placed it at odds with the West.

He replaces Ahmadinejad, first elected in 2005.

A: Yoga is a wonderful complement to any running program. Running is a repetitive exercise and can cause excessive tightness. Tightness in one or more muscle groups can lead to weakness and instability in other muscle groups. Using yoga as a cross-training method will help the body to loosen and lengthen, creating better flexibility and stability through better alignment.

Running is a leg-dominant activity, but runners need more than strong legs. Yoga provides a full-body workout that increases overall strength, including core and upper body. A strong core and upper body allow for better running posture. This helps combat fatigue, decreases risk of injury and allows better breath control.

Breath awareness is a major component of yoga. By consciously connecting the breath to movement, a runner?s pace can become more efficient. Yoga and running are similar in that both require focus and mindfulness. A regular yoga practice gives runners experience in tuning into the body?s signals while helping them keep their mental edge.

Insurgents attack Indian consulate in eastern Afghanistan: officials

KABUL (Reuters) - A suicide bomber attacked the Indian consulate in the eastern Afghan capital of Jalalabad on Saturday, Indian officials and local police said, killing six people and wounding 22.

Gunfire resounded through the area for at least an hour following the 10 a.m. blast near the consulate entrance.

All the casualties were civilians, except for one wounded Afghan soldier, said Baz Mohammad, a senior health official in Nangarhar province.

"Explosion in front of India's Consulate in Jalalabad. All Indians officials safe," Indian Ministry of External Affairs spokesman Syed Akbaruddin said on Twitter.

The attack followed a world-wide travel alert issued by the United States on Friday, saying that Al Qaeda could be planning attacks in August, particularly in the Middle East and North Africa. The United States has ordered the closure of 21 embassies and consulates on Sunday, including its Kabul mission.

Nangarhar police chief Mohammad Sharif Amin told Reuters a bomber detonated a car packed with explosives outside the consulate and an adjacent mosque. The consulate was the intended target, he said, but most casualties were from the mosque.

Roads near the Indian consulate remained blocked as gunfire rattled through the area, deputy provincial police chief Masoom Khan Hashimi said.

Indian diplomatic missions have been targets of previous attacks in Afghanistan.

The eastern border province of Nangarhar, and its capital Jalalabad, have long been a hotbed of insurgent activity.

On Friday, a five-hour battle between Afghan security forces and Taliban fighters in the province's Shirzad district killed dozens of Afghan police and insurgents, officials said.

'Love Potion No. 9' singer sues over Clovers' name

WASHINGTON (AP) ? Harold Winley sang "Love Potion No. 9" and other hits with the R&B group The Clovers in the 1950s, but now the 80-year-old says another group is trying to keep him from performing using the band's name.

Winley says he was in his teens when he and four other singers started performing as The Clovers in the Washington area. The R&B group played at New York's Apollo Theater, eventually signed with Atlantic Records and celebrated when "Love Potion No. 9" became their biggest hit in 1959.

"It was great," said Winley, who now lives in Lauderdale Lakes, Fla. "We didn't make no money but we had a lot of fun."

The group's success fell off in the 1960s, however. And that's when things got more complicated, leading to a lawsuit filed earlier this year in federal court in Washington.

Winley and another band mate, Harold Lucas, went on to perform with separate musical groups that called themselves The Clovers, and Harold Lucas' group eventually trademarked the name in the 1980s. Lucas died in 1994, but two of the men he trademarked the group's name with continue to use it when performing.

Winley says the group has threatened venues who have booked him when he's used The Clovers' name, forcing organizers to cancel his shows at least twice. That's why he filed his lawsuit.

"It is our position that when people come to see The Clovers they expect that they are going to see Harold Winley or another original member of The Clovers," said Winley's lawyer, Brad Newberg.

Winley says his bass voice is still strong and he'd like to perform as much as possible. But if he goes on stage, he said, "I want to go on stage as The Clovers." He recently tried filing a trademark application for "The Original Clovers featuring Harold Winley" but was denied.

A lawyer representing the two men who hold The Clovers trademark did not return several telephone calls and an e-mail requesting comment. The attorney previously filed a court document asking that the lawsuit be dismissed.

The song "Love Potion No. 9" was written and composed by Mike Stoller and Jerry Leiber, the duo behind many of Elvis Presley's biggest hits. The lighthearted song is about a man looking for love who visits a gypsy, who says "what you need is Love Potion Number Nine." He starts "kissing everything in sight" until he kisses a police officer, who the singer explains "broke my little bottle of Love Potion Number Nine."

After The Clovers' version rocketed up the charts in 1959, the song was covered by various groups and singers, most notably England's The Searchers, who had a hit version of it a few years later. The Clovers' version was later featured in George Lucas' iconic 1973 film "American Graffiti." It was later the title of a 1992 Sandra Bullock romantic comedy.

Charles Stevens, one of the group members from Lucas' Clovers, called the lawsuit "frivolous." Stevens, who lives in Washington, said Winley is not an "original Clover" because he didn't start with the group until the late 1940s. Lucas and three others were performing as the Four Clovers before Winley joined.

"All of a sudden he wants to come back and be The Clovers again," Stevens said, adding that his group has had the trademark for decades and now performs two or three times a year.

He says he doesn't mind if Winley uses the name "The Clovers," but he has a problem with the word "original." Stevens says his group had a former agent who may have called venues that booked Winley, but Stevens says he never personally blocked Winley from booking shows.

Both sides have agreed to mediation and will meet Monday to see if they can work things out.

Said Stevens: "We really do want to get this behind us."

While hefty, the prize for Wednesday's drawing is still well below the record $590.5 million jackpot won in May by an 84-year-old Florida woman.

The winning numbers Saturday were 21, 24, 36, 42 and 45; the Powerball was 15.

The odds of matching all six numbers are 1 in 175.2 million.

Powerball is played in 43 states, Washington, D.C., and the U.S. Virgin Islands.

Illinois university stands by professor linked to 1967 killings

CHICAGO (Reuters) - A small Illinois university said on Friday it was standing by a long-time psychology professor recently revealed to have shot and killed his father, mother and teenage sister in Texas more than four decades ago, although he was found not guilty by reason of insanity.

Millikin University, a Presbyterian school in Decatur with 2,380 students, said in a statement that the school expects James St. James, 61, to keep teaching at Millikin this fall.

The school said it "has only recently been made aware of Dr. St. James' past. Given the traumatic experiences of his childhood, Dr. St. James' efforts to rebuild his life and obtain a successful professional career have been remarkable."

St. James, originally James Wolcott, spent six years in a mental institution after the killings but emerged to start a new life, changing his name and getting master's and doctoral degrees in psychology, according to the Georgetown Advocate newspaper.

Georgetown is the Austin suburb where the killings took place in 1967. Reporters for the paper wondered what had happened to Wolcott and traced him to Millikin.

St. James could not be reached for comment Friday.

The news sent a shock wave through Decatur, with city council member Jerry J. Dawson, a former Macon County sheriff, saying that St. James should have told the school about his past before joining the faculty.

"I look at this from a law enforcement perspective, and I just have a problem with somebody who didn't disclose this information," Dawson said. "If I were a parent and my kids were going to Millikin, that's something I would want to know."

In its statement, the university said that St. James had over 27 years "taught a variety of courses at Millikin, served in various leadership roles and built a successful academic career, receiving academic awards including the 1997 Teaching Excellence and Leadership Award."

The Georgetown Advocate said St. James' father was Gordon Wolcott, chairman of the biology department of a local university. The newspaper said James Wolcott had admitted to sniffing some airplane glue on the night of August 4, 1967, and then killing his family with a .22-caliber rifle.

The handheld biosensor was developed by researchers at the University of Illinois, Urbana-Champaign. A series of lenses and filters in the cradle mirror those found in larger, more expensive laboratory devices. Together, the cradle and app transform a smartphone into a tool that can detect toxins and bacteria, spot water contamination and identify allergens in food.

Kenny Long, a graduate researcher at the university, says the team was able to make the smartphone even smarter with modifications to the cellphone camera.

STATE HIGH SCHOOL football teams are receiving an extra day of fall practice this year.

The Oklahoma Secondary School Activities Association will allow its members to start practice on Monday, Aug. 12. Fall practice has traditionally started on Tuesday. The extra day was added to the conditioning period. Practice with pads will start on a Friday, as usual. That will be Aug. 16 this year.

"There's always been a kind of confusion about when practice starts," OSSAA executive director Ed Sheakley said. "We thought starting on Monday would make it easier for everybody and we thought one more day of conditioning before going to full pads would be helpful."

Reaction to the change was mixed during the Oklahoma Coaches Association Clinic held in conjunction with the All-State Games this week in Tulsa. Some coaches were not even aware of the change until they attended the clinic.

"When the proposal came across, I was indifferent about it," Union coach Kirk Fridrich said. "We will try to take advantage of it and treat it as a bonus, but there's only so much you can do without pads."

Glenpool coach Steve Edwards doesn't see the change as being very beneficial.

"I think it's a waste, but I don't mean that in a bad way," Edwards said. "It doesn't really help me a lot with conditioning. I think all programs have their players staying in shape during the summer. As an offensive line coach, you can't really do anything without pads on. It really would help us if we had the extra day with pads."

D.J. Howell is in his first season as Edison's head coach.

"I think the extra day is a good idea," Howell said. "Although kids are staying in shape, I think an extra day to get acclimated to the heat is good. I would rather err on the side of caution. And the extra day will allow us to work on some fundamental stuff."

Memorial first-year coach Ryan Reed was enthusiastic about the earlier start.

"We won't do a lot, but any practice we can get, we want," Reed said.

Coweta coach Bubba Burcham said, "It really does nothing. It's just another day in the heat."

Sand Springs coach Dustin Kinard also was not excited about the change.

"We're not going to even use the extra day," Kinard said. "We'll have our schedule the way we've always done it and start on Tuesday."

Moving up and down: The OSSAA's 2013-14 Annual Daily Membership Report that was released last week brought apparent good news to Edison and Hale. The ADM is used to place teams in classifications for athletics in the 2013-14 school year, except for football. The report is used to determine football districts for the 2014 and '15 seasons.

In order to give schools time to make sure their ADM numbers are accurate, the report won't be official until it's approved by the OSSAA board of directors at their meeting on Aug. 14.

Edison, which moved up to 6A in football for 2012 and '13, will drop back to 5A in 2014 and '15. The Eagles, 1-9 last year, have not had a winning season since 2005. Howell welcomes the move to 5A.

"It will obviously benefit us to play teams our size," Howell said. "But for this year we will look forward to being in 6A and competing with those larger teams, and seeing where we're at."

Hale was in 6A last year except in football but will return to 5A for all sports. Hale's boys basketball team, which has struggled in recent years but showed improvement in 2012-13, could contend for a state tournament berth with the move to 5A.

"We're very excited and glad to be back in 5A," Hale boys basketball coach Joshua McGee said.

The ADM report is a cliffhanger for Kiefer football coach Josh Calvert. Below 5A in football, other classifications aren't certain because there can be movement up or down for fringe teams depending on potential adjustments for private schools. As a result, Kiefer won't know until later this month whether it will be in 2A or stay in Class A for the 2014 and '15 seasons. Ketchum and Kiefer are on the 2A-A borderline. Kiefer just moved up to 11-man football last year.

"We're growing, but I would prefer to be in Class A," Calvert said. "We want to keep on being successful, and our chances of winning a gold ball would be better in Class A."

Union's Smith wins award: Union senior defensive lineman Janson Smith won a National Athleadership Grant sponsored by NCSA Athletic recruiting and the National Football League Players Association. The grant is awarded to student athletes based on leadership in their community, academic achievement, athletics and a required essay.

Time Warner Cable loses CBS channels, CBS says first time dropped from cable

Earlier this week negotiations between CBS and Time Warner Cable broke down and for a few minutes, channels started dropping from the cable service. An extension on the deadline brought channels back quickly, but time is up once again and subscribers are being greeted by the message above. The blackout applies to CBS in New York City, Los Angeles and Dallas, plus Showtime, The Movie Channel, Flix and Smithsonian Channel nationwide. According to CBS, this is the first time it's ever been dropped from a cable system, and it has followed up with a note from Showtime claiming TWC removed the premium channel despite authorization to keep it while negotiations continue. Time Warner Cable has its own statement, claiming CBS has "refused to have a productive discussion" since the Tuesday morning extension in talks.

With the NFL season looming we'll see how long TWC is willing to push CBS.com (which some of you have reported is being blocked by CBS), Aereo and antennas as alternative solutions in these major markets and whether CBS is willing to live without the viewership. Voiceless at the end of life

Doctors rushed an ill-fated motorcyclist with severe injuries to the head and chest to the ICU. Emergent CT scans revealed brain swelling so pronounced it was squeezing out of the skull plus multiple fractures of the bones of the face.

Doctors tried everything: they induced a barbiturate coma and gave treatments to decrease swelling of the brain. When that failed, they tried a last resort: they removed part of his skull to release the lethal pressure build up.

Nothing worked. Periodically all sedation was lifted and ? no speech, no flutter of the fingers, there was no spark of recognition in the eyes. His chest rose and fell solely because of the clockwork suck and whir of a mechanical ventilator. He was punctured by plastic catheters in his neck, his arm, and his penis, and he received liquid nutrition through a tube in his stomach. One by one the inevitable complications of weeks in an ICU marched across his body ? infections, clots, and bedsores.

This is where I came in. I am not a surgeon, or a critical care physician. I am not a priest. But in this hour of mortal need, I was who they called. I am a clinical ethicist, and they asked me to speak up for the right to let a loved one die.

The doctors, nurses, and social workers caring for the patient knew there was nothing more they could do to save his life, and they had confessed this, gently, to his family. Long conversations and then consensus ensued: this fun-loving hobbyist who most loved the open highway and the wind in his hair would not want to live this way.

But there was a catch: he had no legal decision-maker. No one could speak for him, legally.

In most states, there is a clear hierarchy of legal representatives for patients who cannot speak for themselves. First the spouse, then the adult child, then the parents, or a sibling ? and so on down the line.

In my home state, New Hampshire, and a dozen other states, there is no such hierarchy, no statute specifies the chain of command. That means unless the patient has an advanced directive document, or has appointed a durable power of attorney for healthcare, there is no default legal representative.

This puts patients, families, and clinicians in a bind: should we adopt some convenient chain of command by default, or must the legal guardian be specified in court? In practice, the right decision-maker is often obvious, and we listen. But when the decision-maker isn?t clear, or when there is controversy, we get the court to appoint a legal guardian. This can take days or even weeks.

In this patient?s case, there was no uncertainty or controversy. But out of an excess of caution, the family went to court anyway to be designated his legal guardians. The court obliged, with one exception: the judge did not grant them the power to withdraw life-sustaining therapy.

The judge was trying to do the right thing. Confronted with a complicated medical situation and a family he did not know, the judge did not want to move precipitously toward withdrawal of life-sustaining therapy. Plus, he felt obligated by a 1986 New Hampshire state supreme court case called In re: Doris M. Terry to ensure we met certain legal criteria for withdrawal of life-sustaining therapy by a legal guardian. So he asked the hospital to appoint a physician ethicist to describe the patient?s prognosis and to discuss whether it would be ethical to stop life-sustaining therapy.

That is where I came in. I reviewed the records, discussed the case with the ICU team, examined the patient, and met the family. And then, on a hot July day, I put on a suit and took the stand, swearing for the first time to tell the whole truth and nothing but the truth.

I laid it out in plain English: I listed the patient?s injuries, including the missing half of his skull, and I described his poor response to standard neurological tests of brainstem function. I cringed that the patient?s family had to hear the gory details, but none of this was new to them ? they had been witness to this nightmare for weeks.

The judge was thoughtful and concerned, and in the end he ruled the family could withdraw life-sustaining therapy. Soon thereafter doctors slipped the breathing tube out of the patient?s mouth and gave him medicines to prevent air hunger and anxiety.

I was glad the case worked out in the end, but aggrieved the family had to go to court in the first place. The doctors, the nurses, the family and the judge were all acting in good faith. But they were trapped in a legal quagmire. It is long past time for the laws in New Hampshire and elsewhere to give families a voice at the end of life. Unless conflict requires it, we should not turn the deathbed into the scene of a courtroom drama.

Just weeks ago, our patient rode his motorcycle on a sunny day with no idea what was around the next turn. Today he is dying. Trans-Pacific Partnership free trade agreement could lead to fewer U.S. jobs

The Morning Call published the recent story about Lehigh Valley businesses hiring at faster pace. This is good news but gains could be lost with the pending Trans-Pacific Partnership free trade agreement. The Trans-Pacific Partnership dwarfs the North American Free Trade Agreement both geographically and economically and could result in serious job and wage loss in our area.

The proposed pact not only covers traditional trade matters such as tariffs and quotas but also is said to contain some 29 separate chapters affecting everything from food safety standards and banking regulations to energy policy and government purchasing decisions.

Despite having completed 18 major rounds of negotiations on that agreement, the Obama administration has refused to tell the American public what it has been proposing in our name, instead classifying all the draft texts. Now the administration wants Congress to pass new fast-track legislation that would enable the partnership to circumvent ordinary congressional review, amendment and debate procedures.

World stocks rise on hopes of more upbeat US data

HONG KONG (AP) ? World stocks were mostly higher as investors awaited key U.S. data later Friday that they hoped would add further evidence of a strengthening recovery in the world's biggest economy.

Investors' hopes were already raised after a report by the Institute for Supply Management that found U.S. manufacturing activity jumped last month, signaling a rebound in industrial production.

"Holy smokes," economists at Singapore's DBS Bank wrote in a research note. They noted that the report comes after other recent upbeat U.S. data, including second-quarter growth that was better than expected and a surge in durable goods orders.

"Payrolls and the unemployment rate are on tap today. If these green shoots ? or rocket ships in the case of the ISM ? spill over to the labor market, there's going to be a party at the Fed. And on Pennsylvania Avenue. Wall Street."

In early European trading, Germany's DAX was up 0.1 percent to 8,415.49 while France's CAC 40 rose 0.1 percent to 4,043.37. The FTSE 100 index of leading British companies rose marginally to 6,683.40.

U.S. stocks were poised to rise. Dow futures gained 0.1 percent to 15,568.00 while broader S&P 500 futures advanced 0.1 percent to 1,701.90.

In Asia, markets ended higher. Japan's Nikkei 225 index surged 3.3 percent to 14,466.16, with export shares boosted by a weakening yen. Hong Kong's Hang Seng added 0.5 percent to 22,190.97 while in mainland China, the Shanghai Composite Index rose less than 0.1 percent to 2,029.42.

South Korea's Kospi was up 0.1 percent to 1,923.38 and Australia's S&P/ASX 200 climbed 1.1 percent to 5,116.80. Benchmarks in Singapore, Taiwan and New Zealand also rose. Benchmarks in the Philippines and Thailand fell.

Investors were also keeping a close eye on corporate results posted so far during earnings season to get a better idea of how, for example, the economic slowdown is playing out in China, the world's No. 2 economy. The latest sign of China's uncertain economic outlook came on Thursday, when an official Chinese survey of manufacturing activity ticked up unexpectedly though remained weak.

"Essentially, reporting season will be the test of whether or not that negative macro sentiment has really impacted companies on the ground as much as people expect," said Sam Le Cornu, a senior fund manager of Asian equities at Macquarie Funds Group.

"So far we're seeing above expectations on results, and any stock which does beat expectations, you see a rally quite aggressively," said Le Cornu.

Hong Kong conglomerate Hutchison Whampoa Ltd., controlled by billionaire Li Ka-shing, rose 4.2 percent after posting first-half profit that was up nearly a quarter over the year before.

Sony Corp. rose 0.7 percent in Tokyo after the Japanese electronics giant returned to profit in the January-June period after a loss in 2012.

Benchmark crude for August delivery was up 27 cents to $108.15 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.86 to close at $107.89 a barrel on the Nymex on Thursday.

In currencies, the euro slipped to $1.3217 from $1.3226 late Thursday. The dollar edged up to 99.61 Japanese yen from 99.49 yen.

The Wichita Parks Foundation is having a fundraising golf tournament on Aug. 23 at Tex Consolver Golf Course, 1931 S. Tyler.

The foundation is raising money for recreation programs and for a community scholarship fund for 2014 summer camps.

Registration for a four-person team is $500. Registration includes breakfast, lunch, dinner and cart rental. All golfers will receive a free round of golf at a Wichita course.

Berlusconi lays out price of preserving Italian government

ROME (Reuters) - Italy's center right must push through justice reform or withdraw from the coalition government, Silvio Berlusconi told his People of Freedom (PDL) party on Friday after his conviction for tax fraud was upheld by the supreme court.

Just three months after center-left Prime Minister Enrico Letta took office at the head of an uneasy alliance with Berlusconi's PDL, the euro zone's third largest economy faces deep uncertainty that may further hinder efforts at reform.

Struggling to contain deep divisions over tax and economic policy, the coalition's lifespan may depend on when Berlusconi's party considers it most politically expedient to try to force an election.

"If there is no reform of the justice system, we are ready for new elections," Berlusconi told PDL lawmakers at a party meeting on Friday, according to a source who attended and who spoke on condition of anonymity. The media mogul and his supporters maintain the justice system is biased against him.

Five PDL government ministers told the party leadership they were willing to resign if needed, Senator Lucio Malan told reporters after the meeting, saying: "They entrusted their mandates to Berlusconi...We agreed to decide what to do in the coming days."

Yet how imminent a threat such talk may pose remains uncertain, with the 76-year-old billionaire apparently cautious about rushing into action before he is ready.

"Berlusconi said not to take any hasty decisions and to think of the interests of the country," PDL Infrastructure Minister Maurizio Lupi told reporters.

Officials at the meeting also said that senior party members may ask President Giorgio Napolitano to pardon Berlusconi - an idea the president rejected last month.

Letta repeated on Friday that Italy must have a stable government, saying the last thing it needs is to be worn down by partisan battles.

Berlusconi faces the threat of a year under house arrest or in community service as well as losing his seat in parliament over the first definitive sentence he has received in dozens of trials during his two decades in politics.

While he is unlikely to spend any time in jail due to his age, the verdict was an unprecedented blow and a Senate vote on expelling him from parliament could come in September.

He has declared he will continue his political activities under the "Forza Italia" (Go Italy!) name of his first party, with speculation growing that his daughter Marina may succeed him as party leader.

REFORM PROSPECTS DIM

The upheaval means the already dim prospects of significant reforms to revive Italy's stagnant economy and cut its massive debt have receded further.

Agreement over thorny issues such as privatizations due in the autumn, or the much-disputed IMU property tax which Berlusconi wants to scrap but which would blow a hole in already strained public finances, will be difficult.

"It depends on the PDL," Deputy Economy Minister Stefano Fassina, from Letta's center-left Democratic Party (PD), told Reuters.

"It's not something which can be settled in the next few hours but over the next few weeks, we'll have to settle the IMU issue and on an issue like this, it can't just be about Berlusconi's personal interests," he said.

Problems just as serious could also come from Fassina's own fractious camp, with many in the center-left unhappy at the prospect of remaining in alliance with a convicted tax evader.

To add to the problems facing Letta, Matteo Renzi, the ambitious young mayor of Florence, is widely expected to mount a bid to lead the party.

Letta said the situation was "politically very delicate" and called on all sides to show responsibility in the interests of the country. But he acknowledged there were limits to what was acceptable.

"I don't consider that continuing at any cost is necessarily in the interests of the country," he said.

MARKETS CALM

For all the drama surrounding the sentence, financial markets have shrugged off the ruling at least for now, encouraged by the European Central Bank's guarantee to backstop countries that run into difficulty on the bond markets.

The main barometer of investor sentiment, the spread between Italian 10-year bond yields and their safer German equivalents, actually fell on Friday to 261 basis points from 270 the previous day.

Italy's blue-chip share index closed only slightly lower, although shares in Berlusconi's Mediaset media empire ended 2 percent lower.

But the calm could change if prolonged political instability fuelled doubts about Italy's badly strained public finances and created the kind of pressure that brought down Berlusconi's last government as the euro zone crisis peaked two years ago.

With Italy's stagnant economy showing the first faint signs of improvement after two years of recession, it can ill afford months of debilitating stalemate.

Claudio Aspesi, an analyst at research firm Bernstein, said markets anticipated little action during the August summer holidays but tensions would intensify once activity picked up after the break.

"In September this could reignite concerns on the government's survival and the repercussions for the economy," he said.
